دور التحليل النفسي لشخصية المتهم في كشف غموض الجريمة

Abstract

The aim of this study was to determine the role of psychological analysis of the suspect's personality in unraveling the mystery of the crime, as well as to identify methods for uncovering the crime mystery through analyzing the suspect's personality by training the human element in modern techniques to keep up with the continuous developments in this field. This study relied on the analytical and inductive approach, given the interpretation and analysis of the theory of psychological analysis in uncovering the mystery of the crime and identifying the suspect, as well as addressing legal texts and analyzing them, and subsequently presenting the most important findings and recommendations that contribute to the study. The study found several results, including the lack of appropriate psychological assessment and diagnosis, along with misunderstood evidence and economic difficulties. This has led to a system that treats these men and women as criminals rather than individuals suffering from an illness. Usually, criminal justice systems and appointed officials are not knowledgeable about the effects and cognitive processes of a person with a mental disorder. Therefore, it is preferable to apply projection scales in accordance with the theory of psychological analysis to uncover the mystery of the crime and identify the suspect.

One of the key recommendations that emerged from the study is the importance of a good understanding of the criminal personality and their motives for officers working in the field of investigating crimes, particularly those related to events. Additionally, it is crucial for professionals involved in the rehabilitation and reintegration of released prisoners into society to have a deep understanding of criminal personalities. This understanding aims to prevent the reoccurrence of crimes by providing adequate rehabilitation measures. Moreover, the study suggests the development of tests for detecting psychological disorders in criminals, particularly in cases involving crimes of a psychological, financial, or ethical nature. These tests would aid in better understanding the mental state of offenders and potentially assist in identifying potential recidivism risks.

هدفت الدراسة إلى معرفة دور التحليل النفسي لشخصية المتهم في كشف غموض الجريمة " والتوصل لطرق كشف غموض الجريمة من خلال تحليل شخصية المتهم من خلال تدريب العنصر البشري على التقنيات الحديثة لمواكبة المستجدات المتلاحقة في هذا المجال، اعتمدت هذه الدراسة على المنهج التحليلي والاستنباطي نظرا لتفسير وتحليل لنظرية التحليل النفسي في كشف غموض الجريمة والتعرف على المتهم وأيضا بالتطرق إلى النصوص القانونية وتحليلها ومن ثم الخروج بأهم النتائج والتوصيات التي تضيف إلى الدراسة، وتوصلت الدراسة إلى عدد من النتائج منها: إن الافتقار إلى التقييم والتشخيص النفسيين الملائمين ، إلى جانب الأدلة التي يساء فهمها والمصاعب الاقتصادية ، فقد أنتج نظامًا يعامل هؤلاء الرجال والنساء كمجرمين بدلاً من أفراد يعانون من المرض. وعادة ما تكون أنظمة العدالة الجنائية، والمسؤولين المعينين ، غير متعلمين في الآثار والعمليات الإدراكية لشخص مصاب بمرض عقلي ولذا يفضل تطبيق المقاييس الإسقاطي طبقا لنظرية التحليل النفسي لكشف غموض الجريمة والتعرف علي المتهم.

ومن أهم التوصيات التي خرجت بها الدراسة: الإلمام الجيد بجوانب الشخصية الإجرامية ودوافعها للضباط العاملين في مجال مكافحة جرائم الأحداث بصفة خاصة وأيضاً المختصين بمتابعة المفرج عنهم من السجون في إطار التأهيل للعودة للمجتمع لمنع عودة هؤلاء الجناة لارتكاب جرائم أخرى، وإعداد اختبارات للكشف عن الأمراض النفسية للجناة وخاصة في جرائم النفس والمال والجرائم الأخلاقية.
