منهج المشرع الإماراتي في مكافحة جرائم الاتجار بالبشر في ضوء قانون مكافحة الاتجار بالبشر الصادر بالمرسوم بقانون اتحادي رقم (24) لسنة 2023

Abstract

This research analyzes the articles of the Anti-Human Trafficking Law, which was issued by Federal Decree No. (24) of 2023, in order to clarify what is meant by human trafficking crimes in accordance with the provisions of this law, determine the means of committing them, and research the criminalization and punishment provisions for these crimes. The research was prepared following the descriptive approach in order to introduce the theoretical framework of the research, and the analytical method in order to analyze the legal texts related to the research.

One of the most prominent results of the research was that the Emirati legislator was keen, through his definition of human trafficking, to include criminalization of the various forms of human trafficking mentioned in the Protocol, and even added to it the selling of people or offering them for sale, as well as the purchase of people, the promise of people, recruiting them, using them, delivering them, and receiving them. One of the most important recommendations is the necessity of stipulating each form of human trafficking crimes in a separate and specific legal text, with a clear and specific definition.

يتناول هذا البحث بالتحليل مواد قانون مكافحة الاتجار بالبشر الذى صدر بالمرسوم الاتحادي رقم (24) لسنة 2023، وذلك لبيان المقصـود بجرائم الاتجار بالبشر وفق أحكام هذا القانون، وتحديد وسائل ارتكابها، والبحث في أحكام التجريم والعقاب الخاصة بهذه الجرائم. ولقد تم إعداد البحث باتباع المنهح الوصفي وذلك من أجل التعريف بالإطار النظري للبحث، والمنهج التحليلي وذلك من أجل تحليل النصوص القانونبة المتعلقة بالبحث.

وكان من أبرز نتائج البحث أن المشرع الإماراتي قد حرص من خلال تعريفه للاتجار بالبشر على أن يشمل بالتجريم مختلف صور الاتجار بـالبشر التي أوردها البروتوكول، بل وأضاف عليها بيـع الأشخاص أو عرضهم للبيع، كما أضاف شراء الأشخاص والوعد بالأشخاص واستقطابهم واستخدامهم وتسليمهم واستلامهم. ومن أهم التوصيات ضرورة النص على كل صوره من صور جرائم الاتجار بالبشر في نص قانوني مستقل وخاص بها، مع تعريفها تعريفا واضحا ومحددا.
